Der Anlass dieses Textes sind die verschiedenen, im Jahr 2020 bekannt gewordenen, Komplex- Verfahren nach \u00a7129(a) sowie die staatlichen Angriffe auf antifaschistische Strukturen \u2013 von Hamburg bis Stuttgart, von Frankfurt u\u0308ber Berlin, bis Leipzig und Weimar.<\/p>\n

Wir wollen in diesem Text keine gesamtgesellschaftliche Analyse erarbeiten, sondern die Verfahren vielmehr in einen gro\u0308\u00dferen Kontext der aktuellen Repression einordnen. Unsere gesellschaftlichen Analysen und daraus resultierende Einordnungen sind bei der Diversita\u0308t der verschiedenen politischen Stro\u0308mungen zu vielfa\u0308ltig und dadurch teilweise widerspru\u0308chlich. Wir schreiben diesen Text – trotz der politischen Differenzen – als einige Beschuldigte und Soli-Strukturen verschiedener Verfahren gemeinsam, als ein Zeichen gegen Repression:<\/p>\n

Es sind dieselben Bullen und Gesetze, kurz gesagt derselbe Staat, der wenige verfolgt, um die Ideen vieler auf eine bessere Welt zu zerschlagen!<\/p>\n

Repression gegen linke und revolutiona\u0308re Bewegungen ist nichts Neues und hat eine lange Geschichte. Die Repressionsbeho\u0308rden in Deutschland bilden im Kampf gegen diese eine geschlossene Linie. Gerade der Verfassungsschutz, der Generalbundesanwalt oder das Bundeskriminalamt geho\u0308ren zu den Repressionsorganen des Staates, welche die Aufgabe haben, die bestehende Ordnung aufrechtzuerhalten und all diejenigen zu verfolgen, die eine Welt frei von Ausbeutung und Unterdru\u0308ckung aufbauen wollen. Sie verteidigen somit unmittelbar die herrschenden Verha\u0308ltnisse mit all ihren zersto\u0308rerischen Auswirkungen.<\/p>\n

Die Akteur:innen staatlicher Repression handeln jedoch nicht isoliert fu\u0308r sich, sondern sie sind exekutiv dafu\u0308r verantwortlich, die Herrschaft, die aus den gesellschaftlichen und kapitalistischen Kra\u0308fteverha\u0308ltnissen erwa\u0308chst, zu sichern. Fu\u0308r eine Einordnung der aktuellen, konkreten Repressionsschla\u0308ge lohnt sich daher ein Blick auf das fortlaufende Elend der Verha\u0308ltnisse:<\/p>\n

Reaktiona\u0308re und menschenfeindliche Positionen sind konsensfa\u0308higer geworden. Sich zunehmend bewaffnende Nazis (1) haben zusammen mit Alltagsrassist:innen einen direkten parlamentarischen Ausdruck in der AfD gefunden. Wa\u0308hrend also die Reaktiona\u0308ren auf der Stra\u00dfe vom Staatsstreich tra\u0308umen und dafu\u0308r vorbereitend Waffen sammeln, organisieren sich auch die Rechten innerhalb der Beho\u0308rden (2).<\/p>\n

Repression gegen Linke und Antiautorita\u0308re ist immer ein Mittel zur Aufrechterhaltung der bestehenden Ordnung. Emanzipatorische Ideen, die Ausbeutung und Unterdru\u0308ckung ablehnen, sind daher immer Ziel staatlicher Angriffe. Dies zeigt sich insbesondere in Bezug auf gro\u00dfe Mobilisierungen wie beispielsweise den Anti-G20 Protesten. Gerade vor und nach dem G20-Gipfel 2017 kam es zu zahlreichen Gesetzesverscha\u0308rfungen und der Ausweitung polizeilicher Befugnisse auf Bundes- und Landesebene. Die O\u0308ffentlichkeit wurde vielerorts propagandistisch auf die „Gefahr von Links“ eingeschworen. Weitergehend behaupten die Beho\u0308rden eine vermeintlich steigende Gewaltbereitschaft gegen Personen, wie auch ein gesteigertes Organisations- und Mobilisierungspotential. All dies wird als Gefahr fu\u0308r die bestehende Ordnung ausgelegt.<\/p>\n

Die verschiedenen Akteur:innen der staatlichen Maschinerie agieren gema\u0308\u00df ihrer Vor- und Aufgaben. Hierbei zeigt sich, dass die verschiedenen Beho\u0308rden teilweise besondere Schwerpunkte<\/p>\n<\/div>\n<\/div>\n<\/div>\n

legen. Zum einen hat der Verfassungsschutz, neben geheimdienstlicher U\u0308berwachung und Ausspa\u0308hung, die Aufgabe, staatsgefa\u0308hrdende Bestrebungen zu prognostizieren. So beschwo\u0308rt er in den letzten Jahren gebetsmu\u0308hlenartig einen „linken Terrorismus“ (3) herauf und \u201ewarnt\u201c vor einer zunehmenden Eskalation durch \u201eLinksextremisten\u201c bis hin zu „terroristischen“ Strukturen (4). Diese Nutzung des Terrorismusbegriffs bedient dabei die Hufeisentheorie des Staates, um sein Gewaltmonopol aufrechtzuerhalten. Dazu passende Analysen werden vom BKA angestellt. Aus diesem Geflecht heraus haben das BKA und die Staatsanwaltschaften die Aufgabe der Strafverfolgung inne. Im Umkehrschluss dienen die Verfahren, die gegen Linke und Revolutiona\u0308r:innen gefu\u0308hrt werden, den Beho\u0308rden als Beleg fu\u0308r ihre Analysen, man kann also von einer sich selbst erfu\u0308llenden Prophezeiung sprechen.<\/p>\n

Im Zuge dessen wird eine emanzipatorische Bewegung mit gro\u0308\u00dferen Ermittlungsverfahren nach \u00a7 129 bzw. \u00a7 129a u\u0308berzogen. Deren Zielsetzung ist eine Schwa\u0308chung der Bewegung durch Ausspa\u0308hung, Einschu\u0308chterung, Spaltung und soll langfristig eine kollektive Selbstverteidigung der Bewegung in einer krisenbehafteten gesellschaftlichen Situation unterbinden.<\/p>\n

Von staatlicher Seite wird deutlich gemacht, dass lediglich staatstragendes und sich integrierendes politisches Verhalten geduldet wird und legitim sein soll. Der Charakter des repressiven Vorgehens wird durch den Generalbundesanwalt (5) als explizit politischen Akteur verko\u0308rpert. Um in dessen Fokus zu geraten, kann es reichen, politisch widersta\u0308ndig zu denken und zu handeln. Es wird unter anderem durch das Konstrukt vermeintlicher, besonders gefa\u0308hrlicher Anfu\u0308hrer:innen versucht, eine Spaltung und Entsolidarisierung innerhalb der emanzipatorischen Bewegung zu erzeugen. Vor allem durch die mediale Da\u0308monisierung und die Reproduktion dessen durch Teile der Gesellschaft \u2013 aber auch der Bewegung – soll von der Notwendigkeit unseres Widerstandes abgelenkt und der O\u0308ffentlichkeit individuelle Feindbilder geliefert werden. Die hierdurch geschaffene Entpolitisierung erscheint uns als der eigentliche politische Angriff auf uns, jenseits von Haft und Gerichtsverfahren. Es ist ein Angriff auf unsere Inhalte!<\/p>\n

Wie kann also unsere Antwort angesichts der Angriffe des Staates aussehen?<\/p>\n

Es ist wichtig, dass die Verfahren und das \u201ewie weiter\u201c nicht im Verborgenen ausgetragen werden. Anhand der konkreten Fa\u0308lle der Repression ist es mo\u0308glich, unsere Inhalte einer breiteren O\u0308ffentlichkeit versta\u0308ndlich und auf die heuchlerische Politik der Herrschenden aufmerksam zu machen. Es gibt keine objektive Strafverfolgung. Die angeblich neutrale \u201eMitte\u201c und der Staat zeigen ihren tatsa\u0308chlichen Charakter: Wir haben es mit politischer, ideologischer Repression zu tun, die ein klares Ziel verfolgt. So glauben wir, dass Aufrufe wie Wir sind alle Linx, aber auch die Solidarische Prozessbegleitungsstruktur Soli Antifa Ost (6) wichtige Teile einer Strategie sind, die sich offensiv mit der Repression auseinandersetzt und auf eine breitere Resonanz abzielt. Daru\u0308ber hinaus ist es natu\u0308rlich wichtig, Aktionen, Demonstrationen, Kundgebungen und Unterstu\u0308tzung in finanzieller Form zu organisieren. Wir glauben, dass dies eine offene Diskussion ist, an der sich die gesamte Bewegung beteiligen sollte und gemeinsam Verantwortung u\u0308bernommen werden muss.<\/p>\n

Zentral ist zueinander zu halten und die spektrenu\u0308bergreifende Solidarita\u0308t aufzubauen! Der Staat und seine Organe greifen an vielen verschiedenen Orten an, denn es geht ihnen um den Kampf gegen Linke und Antiautorita\u0308re im Allgemeinen, von ihnen werden keine dogmatischen Unterscheidungen gemacht. Was uns (u\u0308ber Unterschiede hinweg) eint, ist die Ablehnung der<\/p>\n<\/div>\n<\/div>\n<\/div>\n

bestehenden Verha\u0308ltnisse und die Perspektive, eben diese zu u\u0308berwinden. Die Solidarita\u0308t untereinander lehnt die Kategorien von \u201eSchuld\u201c und \u201eUnschuld\u201c ab. Gleichzeitig wendet sie sich gegen die staatliche Taktik der Spaltung, durch die emanzipatorische Bewegungen entweder integriert und angepasst oder verfolgt werden. Fu\u0308r uns ist klar, dass es keine Verso\u0308hnung mit den bestehenden Verha\u0308ltnissen geben kann.<\/p>\n

Unsere Ka\u0308mpfe werden nicht in den Kategorien von Bullen und Gerichten gefasst, sondern haben ihren Ausdruck im ta\u0308glichen Kampf zur Umwa\u0308lzung der bestehenden Verha\u0308ltnisse. Wir fu\u0308hren unsere vielfa\u0308ltigen Ka\u0308mpfe fu\u0308r eine Welt ohne Sexismus, Rassismus, Ausbeutung und Unterdru\u0308ckung – fu\u0308r eine solidarische Gesellschaft jenseits des Kapitalismus! Es ist u\u0308ber dieses Communique\u0301 der Soligruppen hinaus wichtig, in Zukunft die gegenseitige Bezugnahme und den Zusammenhalt auszubauen und praktisch werden zu lassen:<\/p>\n

gezeichnet die Verfahren:<\/h1>\n

Hamburg:<\/strong> In Hamburg wird gegen einige vermeintliche Mitglieder des Roten Aufbaus ein \u00a7129a-Verfahren gefu\u0308hrt und gegen die Gruppe und alle, die sie irgendwie dazurechnen ein \u00a7129-Verfahren. Dies gipfelte am 31.08.20 in einem gro\u00dfangelegten Repressionsschlag gegen 22 Beschuldigte mit 28 Hausdurchsuchungen und einer Medienkampagne. Dem waren monatelange Ermittlungen mit jeglichen Befugnissen vorangegangen. Verschiedene Akteure fordern ein Verbot, weil der Rote Aufbau unter anderem die Infrastruktur fu\u0308r die militanten G20-Proteste gestellt haben soll. Seit dem gab es vereinzelt erneute Hausdurchsuchungen, Anquatsch- und Einschu\u0308chterungsversuche wie Stress auf der Arbeit , Hausbesuche etc. Mehr Infos: https:\/\/roter-aufbau.de<\/p>\n

Frankfurt am Main:<\/strong> Nach einem Angriff auf eine Au\u00dfenstelle des Bundesgerichtshof in Leipzig am 1. Januar 2019 werden Ermittlungen nach \u00a7129a eingeleitet. Eine Hausdurchsuchung in Frankfurt folgt 1 1\/2 Jahre spa\u0308ter. Mehr Infos: https:\/\/www.129a.info<\/p>\n

Antifa Ost-Verfahren:<\/strong> Im Dezember 2019 werden in der Umgebung von Eisenach fu\u0308nf Antifaschist:innen festgenommen. Ihnen wird vorgeworfen, gewaltta\u0308tige Neonazis der Kampfsportgruppe Knockout 51 um Leon Ringl angegriffen zu haben. Als die Bundesanwaltschaft und die Soko Linx des sa\u0308chsischen LKA auf den Fall aufmerksam werden, ziehen sie die Ermittlungen an sich. Fu\u0308r die Soko Linx, die bislang keinen der Fa\u0308lle von autonomer Stadtpolitik, derentwegen sie gegru\u0308ndet wurde, auch nur ansatzweise aufkla\u0308ren konnte, ist der Fall ein gefundenes Fressen. Mo\u0308glicherweise ko\u0308nnen sie nun endlich Ergebnisse liefern, wenn auch thematisch anders angesiedelt. So konstruieren sie gemeinsam mit der BAW eine kriminelle Vereinigung, erkla\u0308ren Lina zur Anfu\u0308hrerin, nehmen sie in U-Haft und versuchen den Beschuldigten eine ganze Reihe an Fa\u0308llen von handfestem Antifaschismus der letzten Jahre anzulasten, insbesondere die, bei denen eine Frau beteiligt gewesen sein soll. In sechs dieser Fa\u0308lle, wegen des Vorwurfs nach \u00a7 129 und weiterer kleinerer Delikte wird aktuell gegen vier Personen vor dem OLG Dresden verhandelt. Gegen weitere Beschuldigte laufen noch Ermittlungen der Bundesanwaltschaft\u00a0und der Generalstaatsanwaltschaften Dresden und Gera. Berlin:<\/strong> Die Bundesanwaltschaft ermittelt seit Anfang 2019 gegen mehrere Antiautorita\u0308re aus Berlin wegen Bildung und Mitgliedschaft in einer kriminellen Vereinigung. Der Hauptvorwurf, an der Vorbereitung der Krawalle in der Elbchaussee zum G20 in Hamburg beteiligt gewesen sein, wird flankiert von weiteren Ermittlungen zu diversen, hauptsa\u0308chlich eingestellten, Verfahren in Berliner Kontexten.<\/p>\n

Stuttgart<\/strong>: Eine Auseinandersetzung mit Nazis des rechten Betriebsprojekt „Zentrum Automobil“ am Rande einer Querdenken- Demonstration ist Auslo\u0308ser fu\u0308r eine Welle der Repression in Baden-Wu\u0308rttemberg. Insgesamt werden 11 Wohnungen durchsucht und die Antifaschisten Jo und Dy inhaftiert. Im September 2021 werden Jo und Dy in einem Indizienprozess zu 4,5 und 5,5 Jahren Haft verurteilt. \u00a7 129a \u2013 Germany\u2019s anti-terrorist law, the supposed \u201cmembership of a terrorist organization\u201d justifies all the investigation methods of the state. Implemented in the 1970\u2019s it is since then used traditionally against anti-authoritarians and revolutionaries to criminalize their activities.<\/p>\n

Collective Thesis Paper against Repression \u2013 Down with \u00a7129\/a<\/strong><\/h1>\n

The starting-point of this text are the various complex proceedings under \u00a7129(a) that became known in Germany in 2020, as well as the state attacks on anti-fascist structures – from Hamburg to Stuttgart, from Frankfurt to Berlin, to Leipzig and Weimar.<\/p>\n

In this text, we do not want to develop an overall social analysis, but rather to place the proceedings in a larger context of current repression. Our social analyses and resulting classifications are too diverse given the diversity of the different political currents and thus partly contradictory. We write this text – despite the political differences – as some suspects and solidarity-structures of different proceedings together, as a sign against repression:<\/p>\n

It is the same cops and laws, in short, the same state that persecutes few to smash the ideas of many for a better world!<\/p>\n

Repression against leftist and revolutionary movements is nothing new and has a long history. The repressive authorities in Germany form a united front in the fight against them. Especially the Office for the Protection of the Constitution (VS), the Public Prosecutor General (GBA) or the Federal Criminal Police Office (BKA) belong to the repressive organs of the state, which have the task to maintain the existing order and to persecute all those who want to build a world free of exploitation and oppression. They thus directly defend the prevailing conditions with all their destructive effects.<\/p>\n

The actors of state repression, however, do not act in isolation and for themselves, but are actively responsible for securing the domination that arises from the social and capitalist power relations. For a<\/p>\n<\/div>\n<\/div>\n<\/div>\n

classification of the current, concrete repressive blows, it is therefore worth taking a look at the ongoing misery of the conditions:<\/p>\n

Reactionary and misanthropic positions have become more consensual. Increasingly armed Nazis (1), together with everyday racists, have found a direct parliamentary expression in the AfD (largest far- right party). Thus, while reactionaries on the street dream of a coup d’e\u0301tat and collect weapons in preparation for it, the right-wingers are also organizing inside the authorities (2).<\/p>\n

Repression against radical leftists and anti-authoritarians is always a means of maintaining the existing order. Emancipatory ideas that reject exploitation and oppression are therefore always the target of state attacks. This is particularly evident in relation to large mobilizations such as the anti-G20 protests. Especially before and after the G20 summit in 2017, numerous laws were tightened and police powers at federal and state level were expanded. In many places, the public was propagandistically sworn in to the „danger from the left“. Furthermore, the authorities claim a supposedly increasing willingness to use violence against people, as well as an increased potential for organization and mobilization. All this is interpreted as a threat to the existing order.<\/p>\n

The various actors in the state machinery act in accordance with their priorities and tasks. In this context, it is clear that the various authorities sometimes have special priorities. On the one hand, the intelligence service (VS) has the task, in addition to intelligence surveillance and spying, of forecasting efforts that pose a threat to the state. In recent years, for example, it has been invoking a „left-wing terrorism“ (3) and „warning“ of an increasing escalation by „left-wing extremists“ to the point of „terrorist“ structures (4). This use of the term terrorism thereby serves the horseshoe theory of the state in order to maintain its monopoly on the use of force. Matching analyses are carried out by the Federal Criminal Police Office (BKA). Out of this network, the BKA and the public prosecutors‘ offices have the task of prosecution. Conversely, the cases brought against leftists and revolutionaries serve the authorities as evidence for their analyses, so one can speak of a self-fulfilling prophecy.<\/p>\n

In the course of this, an emancipatory movement is overrun with major investigative proceedings under \u00a7 129 or \u00a7 129a. Their goal is to weaken the movement by spying on it, intimidating it, splitting it up, and in the long term to prevent the movement’s collective self-defense in a crisis-ridden social situation.<\/p>\n

The state makes it clear that only political behavior that supports the state and integrates itself is tolerated and should be legitimate. The character of the repressive approach is embodied by the Federal Prosecutor General (GBA) (5) as an explicitly political actor. In order to come into its focus, it may be enough to think and act in a politically resistant manner. Among other things, the construct of supposed, particularly dangerous leaders attempts to create division and desolidarization within the emancipatory movement. Above all, through the demonization in the media and the reproduction of this by parts of society – but also by the movement – individual enemy images are to be delivered to the public and the necessity of our resistance is to be distracted from. The depoliticization created by this<\/p>\n<\/div>\n<\/div>\n<\/div>\n

seems to be the real political attack on us, beyond imprisonment and legal proceedings. It is an attack on our contents!<\/p>\n

So what can be our response in the face of the attacks of the state?<\/p>\n

It is important that the proceedings and the „how to continue“ are not carried out in secret. On the basis of concrete cases of repression, it is possible to make our contents understandable to a wider public and to draw attention to the hypocritical policies of the rulers. There is no objective prosecution. The supposedly neutral „center“ and the state show their real character: we are dealing with political, ideological repression that has a clear goal. Thus, we believe that campaigns like Wir sind alle Linx, but also the trial information and solidarity escorting network Soli Antifa Ost (6) are important parts of a strategy that offensively deals with repression and aims at a broader resonance. In addition, it is of course important to organize actions, demonstrations, rallies and support in financial form. The state and its organs attack in many different places, because they are concerned with the struggle against leftists and anti- authoritarians in general, no dogmatic distinctions are made by them. What unites us (across our differences) is the rejection of existing conditions and the perspective of overcoming these very conditions. Solidarity among ourselves rejects the categories of „guilt“ and „innocence.“ At the same time, it opposes the state tactic of division, through which emancipatory movements are either integrated and adapted or persecuted. For us it is clear that there can be no reconciliation with the existing conditions.<\/p>\n

Our struggles are not defined in the categories of cops and courts, but have their expression in the daily struggle to overturn the existing conditions. We lead our diverse struggles for a world without sexism, racism, exploitation and oppression – for a solidarian society beyond capitalism! Hamburg:<\/strong> In Hamburg, a \u00a7129a trial is being conducted against some alleged members of the Roter Aufbau, and a \u00a7129 trial against the group and all those who somehow count them as members. This culminated on 31.08.20 in a large-scale repressive strike against 22 suspects with 28 house raids and a media campaign. This was preceded by months of investigations with any authorities. Various actors are calling for a ban because, among other things, Roter Aufbau is said to have provided the infrastructure for the militant G20 protests. Antifa Ost trial:<\/strong> In December 2019, five antifascists are arrested in the surroundings of Eisenach. They are accused of having attacked violent neo-Nazis of the martial arts group Knockout 51 around Leon Ringl. When the case came to the attention of the Federal Prosecutor’s Office and the SOKO Linx of the Saxon LKA, they took over the investigation. For the Soko Linx, which has so far not been able to solve any of the cases of autonomous urban politics for which it was founded, the case is just what they have been waiting for. They may now finally be able to deliver results, although thematically differently situated. Thus, together with the Federal Prosecutor’s Office, they construct a criminal organization, declare Lina to be the leader, take her into custody and try to charge the accused with a whole series of cases of practical antifascism in recent years, especially those in which a woman is said to have been involved. In six of these cases, because of the accusation according to \u00a7 129 and other smaller delicts, four persons are currently being tried at the Dresden Higher Regional Court.
